The Court of Claims of Ohio has approved a $5.25 million settlement in a medical malpractice lawsuit that involved the delivery of a brain-dead infant at Ohio State University Medical Center.
According to court documents, the mother was admitted to the OSU Medical Center during the first stages of labor. However, the doctor failed to properly interpret fetal heart rate tracings, which showed a pattern of disturbing signs. He also delayed to assess the need for a C-section. His negligence ultimately resulted in a hypoxic-ischemic brain injury (due to lack of oxygen and blood flow).
OSU stated that they worked closely with the family to reach a fair and just resolution.
Doctors and hospital staff have a duty to uphold the accepted standard of care throughout the birth process, from labor to delivery. When medical negligence leads to birth injury, a celebrated event can quickly turn into a heartbreaking crisis.
